ORDINANCE NO. 1104
AN ORDINANCE REVISING TIMING OF PAYMENTS AND FEES AND CHARGES APPLICABLE TO BUILDING PERMITS AND AMENDING SECTION 30-3-202 OF THE BERTHOUD DEVELOPMENT CODE: COLLATERAL REQUIRED FOR IMPROVEMENTS, IN THE TOWN OF BERTHOUD, LARIMER AND WELD COUNTIES, COLORADO.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF BERTHOUD, LARIMER AND WELD COUNTIES, COLORADO:
Section 1.
The Town Board of Trustees, in recognition of the unprecedented financial climate that has developed over the last year, hereby approves a TEMPORARY reduction in fees as provided in this ordinance; with the full intention to return such fees to their current or then reasonable levels as soon as local and regional financial and economic conditions permit.
Section 2.
All fees normally due and payable within the Building Permit process excluding Building Permit, Plan Review and Electrical Permit fees are due and payable prior to issuance of a Certificate of Occupancy.
Specific Fees normally calculated and collected as part of the Building Permit process are hereby revised and reduced as shown below:
a. Building Permit = 55% of cost per adopted building code waived
b. Plan Review Fee = 55% of cost per adopted building code waived
c. Electric Permit = 55% of cost per adopted building code waived
d. Parkland Dedication = 50% of applicable rate waived
e. Parkland Development = 30% of applicable rate waived
f. Public Facilities Fee = 30% of applicable rate waived
g. Density Transfer Fee = 100% of applicable rate waived
h. Town of Berthoud Use Tax = 50% of the General Fund 2% Use Tax rate waived
Section 300-3-202: Collateral Required for Improvements is hereby amended as follows:
B. Acceptable Forms of Collateral
1. Change 115% in second sentence to 25%
2. Change 115% in first sentence to 25%
3. Change 115% to 25%
4. Change 115% to 25%
Section 3.
The Fee Reductions identified above in Section 2, a – h, are subject to formal review no later than April 5, 2010.
Section 4.
The Board of Trustees of the Town of Berthoud herewith finds that the adoption of this Ordinance is necessary to provide the funding necessary to maintain the current levels of municipal services which are necessary for the health, safety and welfare of the Town of Berthoud. The fees and changes set forth in this ordinance shall take effect 30 days after publication.
At its meeting February 10, 2009 a public hearing was set by the Board of Trustees of the Town of Berthoud for its meeting held on the 24th day of February, 2009. At the regular meeting of the Board of Trustees, this Ordinance was read, passed and ordered published this 24th day of February, 2009 by a vote of 7 in favor and 0 opposed.
