Town of Berthoud Ordinance No. 1115, Municipal Fees

ORDINANCE NO. 1115
A MUNICIPAL ORDINANCE RE-ESTABLISHING A FEE FOR SERVICES IN THE TOWN OF BERTHOUD, LARIMER AND WELD COUNTIES, COLORADO.
WHEREAS, the Town currently has 2156 residential dwelling units and 164 commercial facilities, for a total of 2320 dwelling units/facilities, which make use of various municipal services. The Town’s staff and the Board of Trustees have determined that based upon the adopted budget for 2010 the income generated in the general fund is going to be insufficient in the amount of approximately $164,245 to adequately fund the existing municipal services; and,
WHEREAS, the Town’s staff and the Board of Trustees have determined that the following expenses were incurred in 2004, 2005, 2006, 2007, 2008 and estimated for 2009 and 2010:

WHEREAS, the Town staff and Board of Trustees have also determined that these municipal services provide a benefit to each dwelling unit and business facility which is proportionally equivalent to the cost of that service;
NOW, THEREFORE, BE ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF BERTHOUD, LARIMER AND WELD COUNTIES, COLORADO:
Section 1. Monthly Municipal Fee.
A monthly municipal fee of $6.02 shall be billed to each residential dwelling unit and each commercial facility with the utility billing statements commencing with the January, 2009 billing and ending with the December, 2009 billing. ($6.02/mo. x 12 mo. x 2320 customers = $167,597. Anticipating approximately 2% in delinquent accounts the net revenue generated for 12 months equals $164,245.)
Section 2. Effective Date.
The Board of Trustees of the Town of Berthoud herewith finds, determines and designates that an emergency exists which jeopardizes the fiscal stability and welfare of the citizens of the Town of Berthoud and this ordinance shall, therefore, be effective upon adoption.
At its meeting Nov. 17, 2009, a public hearing was set by the Board of Trustees of the Town of Berthoud for its regular meeting held on Dec. 8, 2009. After the public hearing, the Ordinance was read, passed and ordered published by the Board of Trustees at its meeting this 8th day of December, 2009.
