Town of Berthoud Ordinance No. 1105

ORDINANCE NO. 1105

AN ORDINANCE AMENDING ORDINANCE 1104 AND LIMITING THE REDUCTIONS OF CERTAIN PAYMENTS AND FEES AND CHARGES APPLICABLE TO BUILDING PERMITS, IN THE TOWN OF BERTHOUD, LARIMER AND WELD COUNTIES, COLORADO.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF BERTHOUD, LARIMER AND WELD COUNTIES, COLORADO:

Section 1.

The Town Board of Trustees, in recognition of the intent to foster single family housing, commercial and industrial building permit in the community, hereby limits the reduction in fees as identified in Ordinance 1104 to the following building permit types:

a. new single-family home building permits,

b. new multi-family, apartment or condominium building permits,

c. new commercial building permits,

d. new industrial building permits, and

e. renovations of structures exceeding 50% of the value of that structure.

Section 2.

The Board of Trustees of the Town of Berthoud herewith finds that the adoption of this Ordinance is necessary to provide the funding necessary to maintain the current levels of municipal services which are necessary for the health, safety and welfare of the Town of Berthoud. The Board of Trustees has also determined that the enactment of this Ordinance is necessary to the preservation of the health, safety and welfare of the Town of Berthoud and pursuant to this emergency clause becomes effective immediately upon passage.

Section 3.

At its meeting April 14, 2009 a public hearing was set by the Board of Trustees of the Town of Berthoud for its meeting held on the 28th day of April, 2009.

At the regular meeting of the Board of Trustees, this Ordinance was read, passed and ordered published this 28th day of April, 2009 by a vote of 7 in favor and 0 opposed.
