AN ORDINANCE APPROVING A FRANCHISE AGREEMENT BETWEEN THE TOWN OF BERTHOUD AND PUBLIC SERVICE COMPANY OF COLORADO.
NOTICE is hereby given that at the regular meeting of the Town Council of the Town of Berthoud, Weld County, State of Colorado, to be held on June 9, 2009 at the hour of 7:00 p.m., at its usual meeting place in the Town Hall, 328 Massachusetts Ave, Berthoud, Colorado, Public Service Company of Colorado, a corporation duly organized and existing under and by virtue of the laws of the State of Colorado, will make application to said Town for the passage of an ordinance granting to said Public Service Company of Colorado a franchise in said Town, entitled:
AN ORDINANCE GRANTING A FRANCHISE BY THE TOWN OF BERTHOUD TO PUBLIC SERVICE COMPANY OF COLORADO, ITS SUCCESSORS AND ASSIGNS, THE RIGHT TO FURNISH, SELL AND DISTRIBUTE GAS AND ELECTRICITY TO THE TOWN AND TO ALL PERSONS, BUSINESS, AND INDUSTRY WITHIN THE TOWN AND THE RIGHT TO ACQUIRE, CONSTRUCT, INSTALL, LOCATE, MAINTAIN, OPERATE AND EXTEND INTO WITHIN AND THROUGH SAID TOWN ALL FACILITIES REASONABLY NECESSARY TO FURNISH, SELL AND DISTRIBUTE GAS AND ELECTRICITY WITHIN THE TOWN AND THE RIGHT TO MAKE REASONABLE USE OF ALL STREETS AND OTHER PUBLIC PLACES AS HEREIN DEFINED AS MAY BE NECESSARY; AND FIXING THE TERMS AND CONDITIONS THEREOF.
The franchise to be applied for will be for a term of twenty (20) years and shall provide for a franchise fee to the Town of in the amount of three percent (3%) of all revenues received from the sale and transportation of gas and electricity within the Town, excluding all revenues received from the Town for the sale of gas and electricity to the Town.
